Agreement to these terms

By using marbl.codes or our services you agree to these terms and to our privacy policy. If you do not agree, please do not use them. These terms apply to all visitors, users and clients.

Our services

Marbl Codes provides website design and development, e-commerce, web applications, hosting, domain and email management, website maintenance and management, marketing, AI and automation, and related digital services. The scope, price and specific terms of any work are set out in the proposal, plan or agreement you accept. Where those documents and these terms differ, the signed document takes priority.

Prices and payment

• Prices on our website are in pounds sterling and exclude VAT unless stated.
• Invoices are due within 14 days unless otherwise agreed in writing.
• Monthly plans are billed monthly and carry the minimum term shown on the plan and in your agreement.
• Third-party costs, such as platform plans, licences, advertising spend and AI usage, are not included in our prices. Where we arrange them for you they are shown separately and agreed first.
• Late payments may incur additional charges and may result in suspension of services.

Using our website

When using our website you agree not to attempt to disrupt it, gain unauthorised access to our systems, or use it for anything unlawful, harmful or fraudulent. Please provide accurate information when you contact us.

Intellectual property

The content, design and code of marbl.codes belong to MEM Digital Ltd unless stated otherwise, and may not be reproduced without our written permission.

For client work, ownership is set out in your agreement. As a general rule, once paid for, you own the bespoke design, content and code created for you, and we keep ownership of our own reusable tools, frameworks and components, which we license to you for use with your site.

AI in our work

We use AI tools, including our AI colleague Serene [AI], to help design, build, check and manage the work we deliver. A person at Marbl Codes reviews anything outward-facing before it is published or sent. Information on our website is general guidance and not professional, legal or financial advice.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or business opportunities. Our total liability for any claim relating to a service is limited to the amount you paid for that service in the 12 months before the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Ending our work

How either of us can end ongoing work is set out in your agreement. We may suspend access to our services immediately if they are used unlawfully or in a way that puts our systems or other clients at risk.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. We would always rather talk first, so please contact us to resolve any concern informally.

Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. For significant changes affecting clients, we will tell you directly.
